Welcome! Seity Health, LLC (“Seity Health,” “us,” “we,” “our”) understands the importance of your privacy. We’ve created this Privacy Policy to explain how we collect, use, disclose, transfer, and store your personal information. This Privacy Policy describes Seity Health’s privacy practices in relation to information we collect through the website, seityhealth.com, operated by us and through all other websites, mobile sites, platforms, tools, and software applications periodically made available by us for use on or through computers and mobile devices where this Privacy Policy appears or is linked, offline through community needs assessments or other service that requires data collection, and through the use of any of our services (collectively, the “Services”). By creating an account, providing information to us (by any means, whether in correspondence, via our Services, or otherwise), accessing or using any of the Seity Services, you are consenting to this Privacy Policy.

Children and our Services
NOTE TO PARENTS
Seity Health has developed its Services to be an enjoyable experience for users of all ages, including those under 18 with parental supervision (“Children” or “Child”). In compliance with the Children’s Online Privacy Protection Act (“COPPA”), a federal law designed to protect Children online, we take Children’s privacy seriously and encourage parents to take an active role in protecting their Children’s privacy and online experience at all times. Children under the age of 18 may not use the Services without parental supervision and permission from a parent or guardian. Except as otherwise outlined in the Children’s Privacy Policy, we do not collect personal information from users under the age of 13. We do not sell personal information of children under 16.
Parental Access
A parent can, at any time, do the following: (1) review, correct, or delete the Child’s personal information; and/or (2) discontinue further collection or use of the Child’s personal information. To do so, please refer to the confirmation email provided to you when you gave consent or contact Seity Health. Please be sure to include your Child’s name and email address, your name and email address, and the name of the Services on which your Child is registered.
Collection and Use of Personal Information
Personal information is data that identifies or can be used to identify a single individual or household. We collect most of your personal information directly from you – in person, by telephone, text or email, and via our Services. If you do not provide the personal information we ask for, it may delay or prevent us from providing those certain products or services to you.
What Personal Information We Collect
You can use some of the Services without submitting any personal information, but you may provide the following personal information while using the Services:
- Identifiers such as first and last name, username, phone number, email address, mailing address, and Internet Protocol address.
- Profile information such as date of birth, gender, marital status, occupation, education, and interests.
- Parent or guardian contact information.
- General geolocation data, such as GPS signals, device sensors, Wi-Fi access points, and cell tower IDs, where you have allowed access to that personal information from your mobile device.
- Audio, electronic, and photographs.
- Professional or employment-related information, such as occupation title.
- Sensitive information such as Personal Information collected and analyzed concerning your health and Personal Information collected and analyzed concerning your sexual orientation.
- If you choose to post content or communicate with us or others on a public platform we host or through user support, we will collect the personal information you provide in those postings.
- Inferences drawn from any of the information identified above to create a profile about you reflecting your preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
We also collect personal information from you automatically when you access and use our Services, including:
- Identifiers associated with browser cookies, web beacons and similar technologies we deploy on the Services.
We may derive personal information or draw inferences about you based on the personal information we, or our partners, collect. Please note that all the personal information we collect may be combined and used for the purposes described in the “How And Why We Use Your Personal Information” section below.
How And Why We Use Your Personal Information
We use your personal information:
- To comply with our legal and regulatory obligations;
- For the performance of our contract with you or to take steps at your request before entering into a contract;
- For our legitimate interests in accordance with the EU’s General Data Protection Regulation (GDPR) or those of a third party; or
- Where you have given consent.
A legitimate interest is when we have a business or commercial reason to use your information, so long as this is not overridden by your own rights and interests.
As part of the performance of our contract with you, or a third party, or to extent we need to take steps before entering into such contract, Seity Health collects and uses your personal information to operate the Services, deliver the products and services you have requested, enable you to participate in interactive features of the Services, including participation in drawings, sweepstakes, contests, or promotions, notify you of product recalls or safety issues, and inform you of other products and services available from Seity Health.
Consistent with applicable law and choices and controls that may be available to you, we may also use personal information collected from you, or from devices associated with you, to:
- Prevent and detect fraud against you or Seity Health, for our legitimate interests or those of a third party, i.e. to minimize fraud that could be damaging for us and for you;
- Prevent unauthorized access and modifications to systems, for our legitimate interests or those of a third party, i.e. to prevent and detect criminal activity that could be damaging for us and for you and to comply with our legal and regulatory obligations;
- Communicate with you about your account with us and to send you information or request feedback about features on our Sites for our legitimate interests, i.e. to be as efficient as we can so we can deliver the best service for you;
- Ensure business policies are adhered to, e.g. policies covering security and internet use, in order to comply with our legal and regulatory obligations, and for our legitimate interests or those of a third party, i.e. to make sure we are following our own internal procedures so we can deliver the best service to you;
- Update and enhance customer records in order to comply with our legal and regulatory obligations, for the performance of our contract with you or a third party or to take steps before entering into such a contract, and for our legitimate interests or those of a third party, e.g. making sure that we can keep in touch with our customers about our Services and services;
- Verify your identity, assist with identification of users, and to determine appropriate services, in order to comply with our legal and regulatory obligations and for our legitimate interests or those of a third party, i.e. to assist with identification of users, and to determine appropriate services. For example, we may verify your date of birth to securely deliver a password reset request;
- Personalize content and experiences we provide to you, for our legitimate interests, i.e. to be as efficient as we can so we can deliver the best service for you;
- Send important notices, such as communication about changes to our terms, conditions, and policies. Due to the important nature of this interaction with Seity Health, you may not opt out of receiving these communications, in order to comply with our legal and regulatory obligations and for our legitimate interests or those of a third party, i.e. to make sure we are following our own internal procedures so we can deliver the best service to you;
- Ensure the confidentiality of commercially sensitive information in order to comply with our legal and regulatory obligations for our legitimate interests or those of a third party, i.e. to protect trade secrets and other commercially valuable information;
- Market our services to: existing and former customers, third parties who have previously expressed an interest in our services, and third parties with whom we have had no previous dealings for our legitimate interests, i.e. to promote our business to existing and former customers;
- Operate, understand, optimize, develop, or improve our Sites, applications, products, services, and operations, including by using guest survey research, for our legitimate interests or those of a third party, i.e. to make sure we are following our own internal procedures so we can deliver the best service to you; and
- Detect, investigate, and prevent activities that may violate our policies, pose safety issues, or be fraudulent or illegal in order to comply with our legal and regulatory obligations and for our legitimate interests or those of a third party, i.e. to minimize fraud that could be damaging for us and for you.
We may also anonymize, aggregate or de-identify personal information so the end-product does not identify you or any other individual and cannot reasonably be used to infer information about, or otherwise be linked to, you or another individual. Such aggregated, anonymized or de-identified information is not considered personal information for purposes of this Privacy Policy and we may use it for any purpose. For example, we may use this information to generate norms by industry, geography, level, etc., to enable us to understand where our services are being utilized, conduct ongoing validation studies, compile reports, improve the services, and for other research purposes.
Cookies and Similar Technologies Used
Technologies such as cookies, beacons, tags, and scripts are used by Seity Health. Cookies are small text files of information stored by the Internet browser on your computer’s hard drive.
There are a number of different types of cookies, however, our Services currently only uses essential cookies. These cookies are necessary to the core functionality of our Services and some of its features, such as access to secure areas. These technologies help us to ensure our Services is functioning properly. We also use these cookies to distinguish between humans and bots in order in order to make valid reports on the use of our Services, to assist with load balancing to make sure Services requests are routed to the same server in any browsing session, and to ensure that requests from one visitor browsing session are always handled by the same server in the cluster.
How to Manage Cookies
You have the right to decide whether to accept or reject certain cookies. You can set your browser not to accept cookies. However, in a few cases, some of our Services features may not function as a result. Essential cookies cannot be rejected, as they are strictly necessary to provide you with our Services.
Do Not Track
We do not track users across the web and therefore do not respond to web browser “do not track” signals.
Communications
We may use your personal information to send you updates (by email, text message, telephone or post) about our products and/or services, including exclusive offers, promotions or new products and/or services.
We will always treat your personal information with the utmost respect and never sell or share it with other organizations for marketing purposes.
You have the right to opt out of receiving promotional communications at any time by:

- Using the “unsubscribe” link in emails or “STOP” number in texts.
We may ask you to confirm or update your marketing preferences if you instruct us to provide further products and/or services in the future, or if there are changes in the law, regulation, or the structure of our business.
Disclosure to Third Parties
Seity does not sell personal information as the term “sell” is commonly understood. However, as defined in U.S. data protection laws, the “Sale” of personal information means disclosing personal information to third parties for monetary or other valuable consideration, in which case we have “sold” data to third partied for the purposes of advertising.
In the past twelve months, Seity has not disclosed information obtained from consumers to certain third parties in exchange for monetary or other consideration or for purposes of cross-contextual behavioral advertising. However, our use of cookies and other tracking technologies may be considered a sale of personal information under certain U.S. data protection laws, in which case the categories of personal data that we have sold or shared include identifiers (e.g., IP addresses) and internet or other similar network activity. Categories of third parties to whom personal data is sold or shared include data analytics providers and advertising and marketing providers. We have not sold personal data of children under the age of 16.
Seity does not share for purposes of cross-contextual behavioral advertising. At times Seity may provide third parties with certain personal information to provide or improve our products, services, and Services.
We routinely share personal information with:
- Our affiliates;
- Service providers we use to help deliver our Services and products to you such as outside counseling services in order to fulfill our contractual obligations at your request;
- Other third parties we use to help us run our business, such as website hosts; and
- Researches (but only in a de-identified form).
When we need to provide your personal data to third parties, we will only share it to the extent necessary to provide you with our Services, and we ensure that we have in place data protection requirements with these third parties. While we provide these third parties with no more information than what is necessary to enable them to provide their services to us, any personal information that you provide these service providers independently is subject to their respective privacy policies and practices.
In certain situations, we may be required to disclose personal information in response to lawful requests by public authorities or regulatory bodies, including to meet law enforcement requirements, in the case of a court order, a summons to appear in court or any other similar requisition from a government or the judiciary, or to establish or defend a legal application. Additionally, we may provide personal information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).
Safeguarding Personal Information
We have implemented technical, administrative, and physical security measures that are designed to protect personal information from unauthorized access, disclosure, use, and modification. We regularly review our security procedures to consider appropriate innovative technology and methods.
Please be aware that, despite our best efforts, no security measures are perfect or impenetrable. Your account is protected by password for your privacy and security. You must prevent unauthorized access to your account and personal information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account. Outages, attacks, unauthorized use, or other factors may compromise the security of user information at any time. In the event of a security breach, we will notify you after becoming aware of such breach.
Retention of Your Personal Information
We will keep your personal information while you have an account with us or while we are providing products and/or services to you. Thereafter, we will keep your personal information for as long as is necessary:
- To respond to any questions, complaints or claims made by you or on your behalf;
- To show that we treated you fairly; or
- To keep records required by law.
We will retain your personal information for the length of time needed to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law (including the resolution of disputes) and in accordance with our contracts.
Different retention periods apply for different types of personal information. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of the personal information, the purposes for which we process your personal information, and whether we can achieve those purposes through other means, and the applicable legal requirements.
When we no longer require your personal information, we will either delete or de-identify it or, if this is not possible, we will securely store it in accordance with this Privacy Policy and cease use of the personal information until deletion is possible. If we de-identify your personal information we may retain this information for longer periods. To support our research and enable historical comparisons, we retain de-identified data indefinitely.
Your Controls and Choices
We provide all users with the ability to exercise certain controls and choices regarding our collection, use and sharing of your personal information. In accordance with applicable law, your controls and choices may include:
- Correcting, updating, and deleting your registration account.
- Choosing or changing your choices for subscriptions, newsletters, and alerts.
- Choosing whether to receive from us offers and promotions for our products and services, or products and services that we think may be of interest to you.
- Choosing to limit participation in health challenges.
- Requesting removal of your personal information from a public forum on one of our Sites;
- Choosing to limit our use of your personal information, in certain circumstances; and
- Requesting access to the personal information we hold about you and that we amend or delete it.

Where Your Personal Information is Held
Information may be held at our offices and those of our third party agencies, service providers, representatives and agents as described (see above: “Disclosure to Third Parties”).
A Note to Users Outside of the United States
We are headquartered in the United States and utilize service providers in the United States.
Therefore, it is sometimes necessary for us to share your personal information outside the country where we originally collected your personal information (e.g. with our offices in the United States, with our service providers located throughout the world, and where there is an international dimension to the services we are providing to you).
If you are a non-U.S. user of the Services, by visiting the Services and providing us with data, you acknowledge and agree that your personal information may be processed for the purposes identified in this Privacy Policy.
If you choose to access our Services outside the United States, Seity Health and our service providers may transfer your personal information to, or access it in, jurisdictions that may not provide equivalent levels of data protection as your home jurisdiction. In particular, you are advised that the United States of America uses a sectoral model of privacy protection that relies on a mix of legislation, governmental regulation, and self-regulation.
We will, however, ensure the transfer complies with data protection law and all personal information will be secure. If you are located outside the United States, we will only transfer your personal information if:
- you provide your explicit consent;
- the country to which the personal information will be transferred has been granted an appropriate adequacy decision by your local supervisory authority; or
- we have put in place appropriate safeguards in respect of the transfer, for example we have entered into the appropriate standard contractual clauses and required additional safeguards with the recipient, or the recipient is a party to binding corporate rules approved by a supervisory authority.
Where the laws of your country allow you to do so, by using the Services or the services or by providing your data, you consent and authorize Seity to transfer, store, and use all such personal information in the United States (and any other country where we operate) which may not offer an equivalent level of protection to that required in the country where you reside and to the processing of that personal information by us on our servers located in the United States, as described in this Privacy Policy. If you do not want your personal information transferred to the United States and any other country where we operate, please do not submit any information to us or use our Services or the services.
Your Rights Under U.S. Privacy Laws
Certain laws like the California Privacy Rights Act, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, and other state privacy laws that are effective, grant you rights to control your personal information. Consistent with these laws, Seity gives you options to access, edit, or remove certain information. Although some of these rights apply generally, certain rights will only apply to limited individuals or circumstances depending on your state residence.

Right to Appeal
We hope that we can resolve any query or concern you raise about our use of your personal data. However, if we do not take action on your request to exercise any of your rights, we will inform you without undue delay after the receipt of the request for not taking action. Residents of Colorado, Connecticut, Virginia, Utah, and other states with this right may appeal any decision we have made about your request by following the instructions in the communication you receive from us notifying you of our decision.
California “Shine the Light” Law
If you are a California resident, California Civil Code Section 1798.83 permits you to request information once per calendar year regarding the disclosure of your personal information by Seity to third parties for the third parties’ direct marketing purposes. We take great pride in the relationship of trust we have built with our guests over many years, and we are dedicated to treating your personal information with care and respect. Pursuant to California Civil Code Section 1798.83(c)(2), Seity does not share guests’ personal information with others outside of Seity for those parties’ direct marketing use unless a guest elects that we do so.

Nevada Privacy Law
Nevada residents have the right to opt-out of the sale of their personal information by, emailing us at the contact information below. We will respond to your request within the time required by law and, once verified, we will maintain your opt-out request in the event our practices change. Please note that we do not sell Personal Information in accordance with Nevada law at this time.

In some regions (like the European Economic Area), you have certain rights under applicable data protection laws, such as the General Data Protection Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

We generally process personal information of those residing in the European Union on the legal basis of our legitimate interests. Where appropriate, we may rely on alternate legal bases, such as your consent to certain types of processing. Where we process your personal information on the basis of consent, we will clearly obtain your opt-in consent.
Where you have provided consent to certain data processing, you have the right to withdraw that consent at any time by contacting us. A withdrawal of consent will not affect the validity of our use of your personal information up until the point you have withdrawn your consent.

Privacy Rights Requests
You may exercise any of rights set forth in this Addendum by:

If you choose to contact us directly by email or phone, you will need to provide us with:
- Enough information to identify you (e.g., your full name, email address, and address);
- Proof of your identity and address (e.g., a copy of your driver’s license or passport and a recent utility or credit card bill); and
- A description of what right you want to exercise and the information to which your request relates.
For residents of U.S. states:
We may also validate any requests sent directly to us with our customers we have contracted with to provide you our Services or services.
You may use a representative, called an “Authorized Agent,” to submit a request to us. An Authorized Agent means a natural person, or a business entity registered with the California Secretary of State, that you have authorized to act on your behalf. In order to protect your privacy, Seity Health requires you to confirm that you have provided the Authorized Agent permission to submit the request and you must provide the Authorized Agent with signed permission. “Signed” means that the written attestation, declaration, or permission has either been physically signed or provided electronically pursuant to the Uniform Electronic Transactions Act. An Authorized Agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 must submit proof of statutory power of attorney, but consumer verification is not required. Seity Health may deny a request from an Authorized Agent that does not submit proof that they have been authorized to act on your behalf. Requests submitted by an Authorized Agent will still require verification of the person who is the subject of the request in accordance with the process described above.
For requests to delete, access, and portability requests, we are not obligated to make a data access or data portability disclosure if we cannot verify that the person making the request is the person about whom we collected personal information or is someone authorized to act on such person’s behalf.
Any personal information we collect from you to verify your identity in connection with your request will be used solely for verification purposes.

How to File a GDPR Complaint

Seity may offer you certain benefits in connection with the disclosure of personal information and data associated with user accounts.
We may offer you the opportunity to be eligible for certain perks and benefits such as rewards and discounts. All benefits are free of charge.
When you participate in these perks and benefits, we will collect and keep the personal information you provide, or that you’ve previously provided, including your date of birth, country, and email address, which are required. We may also collect and use the following categories of personal information listed in connection with your accounts, including personal information we’ve previously collected about you:
- Identifiers
- Protected classifications
- Online activity information
- General geolocation data
- Commercial information
- Inferences
We collect this information through your interactions with us and our partners, as further detailed in our Privacy Policy. The benefits to you are reasonably related to our good-faith estimate of the value provided to us by their personal information. The value of personal information to us varies by individual and is related to the value of the rewards and discounts provided to you, minus the costs of providing those benefits.
You may withdraw from participation from any rewards program at any time by following the instructions provided upon enrollment.
Third Party Websites
If, in your interactions with the Services, you are linked or directed to, or click on, a third party website, we cannot control what information you may provide to that party or on that website, and we are not responsible for how that party may use or disclose any information you may provide to them. This is not as an endorsement by us of any third party website, content that may be offered on such third party website, or of any products or services provided by such third party. We do not control, nor are we responsible for, such third party website, product or service offerings. As such, we urge that you exercise caution before providing them with your personal information and to review the third party’s privacy policy for information on its data processing practice.
